Appeals court rules AT&T can build 450-foot tower near Boundary Waters

The Minnesota Court of Appeals ruled Monday that AT&T can build a 450-foot cell tower near Ely, Minn., reversing a lower court decision, the Star Tribune reported.

A Hennepin County judge said the tower would have a "materially adverse effect on the environment," since it will also have flashing lights, Fox 9 News reported.

The Friends of the Boundary Waters Wilderness sued AT&T over the tower because it would be visible from the Boundary Waters Canoe Area, they told the Star Tribune.

The Appeals Court ruled the lower judge did not properly weigh how drastic the effects of the tower's visibility would be.
